Please read these terms and conditions carefully before using Our Service.

PhoneWalls (“PhoneWalls” or “we” or “us” or “our”) app showcases thousands of stock wallpapers. We also offer high quality exclusive wallpapers and live wallpapers which is a part of Pro membership. Because it requires an active subscription, we need Terms of Use in place.

By using the PhoneWalls application (“app” or collectively, the “Services”), you agree to be bound by both our Terms of Use (“Terms”) and our Privacy Policy. This is a legal agreement between you and us. If you do not agree with any of these Terms, then simply do not use the PhoneWalls app. Each time you use or access the PhoneWalls app, you are responsible for being familiar with any changes or modifications to these Terms of Use, which could happen at any time.

Fees and Charges

PhoneWalls app contains In-App-Purchases (“IAPs”) to unlock unlimited download and premium features. Please be aware that IAPs are non-refundable. Make sure you require authentication for all purchases within the Apple App Store and Google Play Store’s settings to avoid accidental purchases. It’s a great feature.

The PhoneWalls app consists of high quality wallpapers. Regular usage can use a lot of data. Please be aware that your Internet Service Provider or mobile carrier’s normal rates and fees may apply to your use of PhoneWalls. You are solely responsible for such charges and fees. 

Sharing Our Exclusive Content is Prohibited

All the premium wallpapers in the Premium page of our App are either designed or modified by the PhoneWalls team. Sharing these walls outside of the PhoneWalls app is strictly forbidden. You CAN NOT share any of the premium page content, even if you are a Pro member. Premium wallpapers are only for personal use and you can edit or crop the wallpaper to your liking and use it on your device but can not share them with others. We have the right to hold you responsible and pursue legal action if you share our exclusive content without our permission. 

However you can share stock wallpapers and live wallpaper with your friends.

Links to Websites

Our app may contain links to third-party web sites or services that are owned or used by the PhoneWalls team. These pages include social media channels and other wallpaper related contents.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit from the app.

Claims of Copyright Infringement

We try our best to upload non-copyrighted content on our app to the best of our knowledge. If you see anything on the PhoneWalls app that you believe infringes your copyright rights, please contact us at [email protected] with the following information so we can easily remove it.

Identification of the copyrighted work(s) claimed to have been infringed (for example, a copy of or link to your original work);

Identification of the material on our servers and information sufficient to allow us to locate and remove the material (for example, the name given to the allegedly infringing content on the PhoneWalls app);

A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by you as copyright owner, or by your agent, or by law (e.g., the use is not allowed by Section 107 of the U.S. Copyright Act);

A statement that the information in your notice is accurate, and under penalty of perjury, that you are the owner (or authorized to act on behalf of the owner) of the exclusive copyright right that is allegedly being infringed.

Your physical or electronic signature, or of someone authorized to act on your behalf;

Instructions on how we may contact you: including email, address, and phone number.

We respond to notices of claimed copyright infringement in accordance with the Digital Millennium Copyright Act (“DMCA”). It is our policy to terminate the account of any user we determine, in our sole discretion, to be a repeat infringer of copyrights.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the PhoneWalls be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.

Terms of Use Changes

We reserve the right, at our sole discretion, to change or modify portions of these Terms at any time. If we do this in a way that changes your rights, we will post the changes on this page and will indicate at the top of this page the date these terms were last revised. We may require you to provide consent to the updated Terms before further use of the Services is permitted. Otherwise, your continued use of the Services after the date any such changes become effective constitutes your acceptance of the new Terms. If you do not agree to the amended Terms, you must stop using the Services. However, any dispute that arose before the changes shall be governed by the Terms that were in place when the dispute arose.
